Please read these Terms of Service carefully before using the ConsentYes platform. By accessing or using ConsentYes, you agree to be bound by these terms.
1. Acceptance of terms
By creating an account or using any part of ConsentYes, you confirm that you are at least 18 years old, have the authority to bind your organisation to these terms, and agree to comply with them.
2. Description of service
ConsentYes provides consent management tools for websites, including consent banners, cookie settings, cookie scans, consent records, Google Consent Mode v2 support, and privacy request workflows. The service may be updated or modified over time.
3. Account registration
You must provide accurate and complete information when registering. You are responsible for maintaining the security of your account credentials and all activity that occurs under your account. Notify us of unauthorised access at security@consentyes.co.za.
4. Acceptable use
You agree not to:
- Use ConsentYes for unlawful purposes or to facilitate non-consensual data collection.
- Attempt to gain unauthorised access to our systems or other users' accounts.
- Reverse-engineer, decompile, or disassemble any part of the platform.
- Use the platform to send spam or unsolicited communications.
- Misrepresent your identity or impersonate any person or organisation.
- Interfere with the integrity, security, or performance of the service.
5. Trial, paid plans, and billing
ConsentYes offers a 7-day trial on the Starter plan, followed by paid plans. Starter is R99/month for 1 domain and 2,000 sessions/month. Professional is R299/month for 3 domains and 20,000 sessions/month. Custom plans may support custom domains, sessions, app consent, or other requirements.
All fees are billed in South African Rand unless otherwise stated. We may change pricing with notice. Refunds are provided at our discretion and subject to applicable consumer protection law.
6. Intellectual property
All content, software, and technology that make up ConsentYes are owned by us or our licensors and are protected by South African and international intellectual property laws. These terms do not grant permission to use our trademarks, logos, or brand elements without written approval.
7. Your data
You retain ownership of data you upload to or generate through ConsentYes. You grant us a limited licence to store and process that data solely to provide the service. We do not sell your customer data. See our Privacy Policy for more detail.
8. Compliance responsibility
ConsentYes helps support POPIA-ready consent experiences and audit-ready records. It does not guarantee legal compliance with POPIA, GDPR, or any other legislation. You remain responsible for your own compliance obligations and should seek legal advice where needed.
9. Limitation of liability
To the maximum extent permitted by South African law, ConsentYes is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability in any matter related to these terms shall not exceed the amount paid to us in the three months preceding the claim.
10. Termination
You may cancel your account at any time. We may suspend or terminate access if you breach these terms, engage in fraudulent activity, create security risk, or if required by law. After termination, your right to use the platform ends and data may be deleted according to our retention practices.
11. Governing law
These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of South African courts.
12. Changes to terms
We may update these terms from time to time. Continued use of ConsentYes after updated terms are posted constitutes acceptance of the updated terms.
